Drive + Moto general rental conditions

Envie2Rouler Corse Company (hereinafter the “Lessor”), located at RTE NATIONALE 193 - CASATORRA 20620 BIGUGLIA, operates the rental of motorcycles and scooters, also referred to as “Vehicles,” to any individual or legal entity (hereinafter the “Renter”). The Lessor provides the Renter, on a personal and non-transferable basis, with a vehicle specified in the “Rental Agreement” for a fixed duration. The Renter accepts and agrees to abide by these General Rental Conditions as well as the specific terms of the “Rental Agreement.”

Article 1: Reservation Terms

The Renter makes their reservation online on the website at https://www.aircorsica.com.

The Renter can book a Vehicle as part of a “Drive + Moto” rental directly on the website, which will generate an e-voucher allowing the collection of the reserved two-wheeled vehicle at the Envie 2 Rouler agency.

The availability of a non-electric motorized two-wheeled vehicle is exclusively the responsibility of the Lessor. Air Corsica cannot be held liable in this regard.

Article 2: Rental Conditions

At the time of departure, the Renter must meet the following obligations:

  • Be the sole driver designated in the contract.
  • Have held a driving license for more than two years on the first day of the rental.
  • Hold an A license to drive any type of Vehicle available for rental.
  • Hold an A1 license to drive 125cc Vehicles.
  • Hold an A2 license to drive a Vehicle complying with power restriction conditions, i.e., 47 horsepower.
  • Not have had a driving license suspended or revoked in the last 3 years.
  • Have all the physical capacities necessary to operate a motorcycle or scooter.
  • Use the Vehicle exclusively in Corsica.

The Lessor reserves the right to cancel the rental contract without any compensation or penalty if the Renter fails to meet these obligations.

Article 3: Price

Prices are guaranteed at the time of Vehicle rental. Prices include VAT and are calculated according to rental dates, the reserved Vehicle, and any selected options.

The rental price is the one stated in the “Rental Agreement.” Any changes initiated by the Renter or the Lessor may lead to a price adjustment. Cancellation, modification, or no-show terms are set forth in Articles 6 and 7 of these General Conditions.

Rental prices shown on the Air Corsica website at https://www.aircorsica.com apply only to bookings made on that site. The Lessor reserves the right to modify prices with notice and to inform the Renter by email, who may then choose to cancel the booking without penalty.

Mileage is unlimited for all rental durations in Corsica.

Article 4: Documents to Provide

At departure, the Renter must present the following documents:

  • The original motorcycle license of the Renter, or the original certificate of training or 125cc license of the Renter (loss or theft certificates are not accepted).
  • A valid identity document (national identity card or passport).

If the Renter does not meet the age and/or license requirements, the Lessor is not obliged to provide the vehicle. The rental will be canceled and a cancellation fee equal to 100% of the rental amount will be charged to the Renter.

Article 5: Deposits - Deductible

At the start of the rental, the Renter must pay a security deposit, which also serves as the deductible, the amount of which is specified in the “Rental Agreement,” by credit card (in the name of the Renter who must be present at the time of departure).

Only embossed credit cards in the name of the driver are accepted for payment.

Not accepted: cash, checks, Maestro cards, Electron cards, Indigo cards.

If the “Credit Card Group” or the company Envie2Rouler refuses the deposit, the rental will be canceled and the Renter will be liable for cancellation fees corresponding to 100% of the rental amount.

Deposits:

For persons holding a driving license for less than 3 years, the deductible specified in the contract for the insured vehicle will be increased by 25%.

  • €1,500 for scooter eco categories, 125cc motorcycles and scooters, 125cc “mini price” motorcycles and scooters, scooters, roadsters, A2 license motorcycles (except Tracer 700, for which the deposit is €2,000);
  • €3,000 for prestige* and touring categories.
  • Subject to availability

5.1 Deductible Buyback

For a fee of 1% of the deductible amount of the selected vehicle per day, through the “Premium Pack” option, the client benefits from a deductible buyback which reduces the deductible amount in case of an incident to €750.

Article 6: Cancellation, Modification, and No-Show Policy by the Renter

Cancellation of the Drive+Moto package will not be refunded unless the transport ticket (round-trip ticket) is refunded to the Client.

No refund will be given if the Client does not show up at the check-in for their flight on the scheduled day. This is called a “no show.”

Modification by the Renter after purchasing a transport ticket only:

Passengers who initially purchased only a transport ticket can later book a vehicle rental after purchasing their plane ticket by contacting Envie2Rouler directly by email at corse@envie2rouler.com and/or by phone at 02 47 49 11 06 (non-taxable number, local call price).

To benefit from the negotiated motorcycle rental rate under this contract, the Client must also provide Envie2Rouler with their Air Corsica flight booking reference number.

Cancellation of Vehicle Rental Booking made during the purchase of the “Drive+Moto” Package before the scheduled rental day:

  • 100% refund of the rental amount if the cancellation occurs at least 48 hours before the scheduled rental day.
  • 50% refund of the rental amount if the cancellation occurs 24 hours before the scheduled rental day.
  • No refund if the cancellation occurs on the calendar day of the scheduled rental.

Modification by the Renter after purchasing a “Drive+Moto” package up to 24 hours before the rental start day:

Passengers who initially purchased a package may modify the vehicle rental duration after this purchase by contacting Envie2Rouler directly by email at corse@envie2rouler.com and/or by phone at 02 47 49 11 06 (non-taxable number, local call price).

However, if the entire package must be modified, including the transport ticket, the Renter must contact Air Corsica customer service at 09 69 36 22 20 to modify their package.

Article 7: Modification or Cancellation Policy by the Lessor

In case of force majeure or unavailability, the Lessor may be forced to cancel or modify the booking:

Replacement of a motorcycle or scooter with a model of equivalent or higher category will not give rise to any compensation.

If the Lessor must cancel the booking for any reason, the Renter will be fully refunded the rental amount. The refund will be made by bank transfer within 15 days.

Article 8: Vehicle Provision

Agency Opening Hours:
Envie2rouler commits to being present at the arrival airport from the first Air Corsica flight of the day until the last Air Corsica flight of the day. The agency is obliged to stay informed of any flight delays or cancellations to await the Renter.

8.1 Vehicle Provision and Return
Vehicles are new. By accepting these General Rental Conditions, the Renter acknowledges not having noticed any damaged or scratched parts before departure. Any remarks regarding the vehicle or its accessories condition, as well as rented equipment, must be made in writing on the vehicle condition form, which can be provided before departure.

Upon vehicle provision, the Renter assumes responsibility as defined in Article 1384 of the French Civil Code. The vehicle must be returned in the same condition and with the same fuel level as at departure. No refund will be given for fuel remaining above the initial level.

The rented vehicle must be returned to the return agency specified in the Rental Agreement.

During the entire rental period, the Renter remains responsible for the vehicle and any damage, theft, attempted theft, or vandalism. If keys, vehicle papers, accessories, or equipment are not returned at the end of the rental, the rental period will continue until the Renter provides an official loss declaration. Replacement costs will be charged to the Renter.

8.2 Vehicle Use
In accordance with Article 1984 of the French Civil Code, during the rental, the Renter agrees to use the two-wheeled vehicle reasonably. The Renter also agrees to drive respecting French traffic laws and regulations. The Renter is responsible for any traffic tickets issued against them and agrees to reimburse the Lessor if the Lessor advances payment. If the Lessor receives a fine or request for information from the Public Prosecutor, the designated Renter will be reported and an administrative fee of €45 including tax will be charged.

8.3 Rental Duration
The rental is granted for a fixed period indicated in the Rental Agreement. Any delay exceeding one hour beyond the scheduled return time will automatically result in a charge for an additional full day, depending on the rented vehicle. Any partial day is charged as a full day.

If the vehicle is not returned within 24 hours after the scheduled return date and without prior written agreement from the Lessor, the Renter risks legal action for vehicle misappropriation and breach of trust.

The Renter may request an extension. If accepted, the Renter will be billed at current rates. Any additional insurance(s) taken will be tacitly renewed for the extra day(s). The Lessor reserves the right to refuse any extension without compensation, and the Renter must return the vehicle at the original date.

8.4 Early Termination by the Lessor
The Lessor reserves the right to terminate the rental immediately and without compensation if the Renter fails to comply with all obligations of these General Rental Conditions.

8.5 Early Termination by the Renter
If the Renter returns the vehicle before the scheduled end date, no refund will be granted.

Article 9: Additional Fees – Drop-Off Fees

As stated in Article 5, the Renter must pay a deposit indicated in the Rental Agreement before the start of the rental. The Lessor reserves the right to debit all or part of this amount in the following cases: responsible accident, damage, theft, fire, vehicle loss, non-return of accessories, fuel, extra days, and additional services not paid before departure.

At rental start, the Renter receives the keys with a full tank of “unleaded 98” fuel and must return it with the same amount of “unleaded 98” fuel. Otherwise:

  • If the Renter returns the vehicle without a full tank when it was planned in the reservation: €49 including tax will be payable directly to the return agency. This charge is exclusively managed by Envie2rouler.
  • If the Renter returns the vehicle without a full tank when it was not planned in the reservation: €79 including tax will be payable directly to the return agency. This charge is exclusively managed by Envie2rouler.

The Renter agrees in advance that the Lessor may debit these fees from the pre-authorization hold on the Renter’s credit card used for the deposit.

Drop-Off Fees

A €99 including tax drop-off fee may be charged in the following two cases:

  • The Renter booked a multi-destination flight (example: Marseille – Ajaccio outbound and Bastia – Marseille return). In this case, drop-off fees are charged during the online purchase on the website, in addition to the transport ticket and vehicle rental.
  • The Renter did not select a multi-destination flight option during package purchase, so drop-off fees were not offered. However, the Renter later decides for personal reasons to change the return airport after using the outbound trip in Corsica. In this case, the Renter must contact the agency directly to pay the drop-off fees separately at the return agency. This charge is exclusively managed by Envie2rouler.

Article 10: Tenant’s Obligations

The Renter agrees to use the mechanical anti-theft device provided with the vehicle during every parking. This anti-theft device will not be charged by Envie2rouler.

The Renter commits to maintaining the vehicle, specifically checking the oil and coolant levels every 500 km, and agrees to promptly report to the Lessor any anomalies, malfunctions, or breakdowns occurring during the rental. Repairs, part replacements, or supplies resulting from abnormal wear, negligence, or accident are the Renter’s responsibility.

The Renter must immediately notify the Lessor of any observed anomaly or accident, after having parked the vehicle in a secure place, to mutually agree on whether the rental can continue or if the vehicle must be immobilized for repair.

In case of vehicle immobilization, the rental continues under the normal terms of the Rental Agreement, and the Renter’s obligations remain in force.

The Renter agrees not to use the vehicle under the influence of alcohol, drugs, or any other substance affecting their consciousness or reaction ability.

The Renter must respect vehicle regulations and use it “as a prudent person.”

The Renter acknowledges having received the vehicle clean at the start of the rental.

The Renter agrees to pay the rental price in full as agreed and to indemnify the Lessor for all fines and legally imposed fees resulting from traffic violations incurred, which the Lessor may have advanced.

The Renter agrees to wear a helmet and gloves compliant with current standards and the traffic code, as well as appropriate protective gear for motorized two-wheelers. Envie2rouler and its rental agencies disclaim all responsibility for injuries caused by failure to wear these items.

Article 11: Protective Measures

Additional Sales and Extra Fees

Additional sales concern the following Products with defined prices and services:

  • Equipment for driver and/or passenger:
    • €10 per day per helmet (no equipment included by default in the rental),
    • €5 per day per pair of gloves,
    • €20 per day per jacket.

The additional rental or provision of a helmet and gloves is mandatory for the driver and any passenger unless the Renter signs a liability waiver for both driver and passenger, certifying they have their own equipment.

If the Renter refuses to sign such a waiver, the vehicle rental will be canceled without refund.

Article 12: Complaint and Fine Management

Envie2rouler commits, through its customer service, to handle complaints from Renters related to the rental of two-wheeled vehicles via the purchase of a "Drive + Moto" package.

Regarding fines, the Renter is responsible for all fines and fees resulting from their use of the vehicle or any additional drivers. These fines may include:

  • Parking violations fines in Corsica,
  • Post-parking fines if parking fees are not immediately paid or paid insufficiently,
  • Speeding fines in Corsica,
  • Any other taxes or fines.

If a fine or fee payment is requested from Envie2rouler because the Renter failed to pay immediately or did not comply with the law, Envie2rouler reserves the right to charge the Renter:

  • An administrative management fee of €45 for each fine or fee claimed,
  • The amount of the fine or post-parking fee paid by Envie2rouler plus incurred costs, which amount to a flat rate of €45.

If Envie2rouler receives a fine due to the Renter’s failure to comply with the law, Envie2rouler may disclose the Renter’s details to authorities and charge an administrative management fee of up to €45 per fine or fee.

The Renter may contest the administrative fees and fines within 14 business days from the invoice date sent by Envie2rouler. Reimbursement will only be made if the Renter proves immediate payment of the parking fee with a legible receipt displayed in the vehicle or proves they are not responsible for the violation.


Article 13: Immobilization, Breakdown, Assistance

In case of a breakdown or accident occurring during the rental that immobilizes the two-wheeled vehicle, the Renter benefits from an assistance service approved by the Lessor. The two-wheeler will then be towed and/or repaired. This assistance service is reserved for the driver and any passenger.

Assistance can only be requested once per Renter. If the Renter refuses the solutions proposed by the assistance service for any reason, they cannot claim any reimbursement of expenses from either the assistance service or the Lessor.

Envie2rouler offers the Client a permanent assistance service related to the use of the Vehicles (provided by HONDA ASSISTANCE MOTO), including, in France:

  • In case of breakdown covered by the manufacturer’s warranty, Honda France warranty, or extended warranty;
  • For fortuitous events such as punctures, lost keys...;
  • For information needs about our dealer network or to organize, with the support of your insurance company, services required following an accident, illness, theft...

Article 14: Insurance

In case of an incident, material damage, or theft of the rented vehicle, costs remain the responsibility of the Renter up to the maximum financial liability limits indicated in the Rental Agreement. In case of an incident, the Renter must report it to the Lessor within 24 hours of occurrence (in accordance with article L 113.2 of the Insurance Code) and provide a duly completed and signed amicable accident report by the involved parties. Submission of a report or a detailed declaration is mandatory. Furthermore, in case of theft or attempted theft, a complaint must be filed with the competent authorities within 24 hours by the Renter; the deposit will then be fully retained. Failure to comply with these formalities results in the loss of optional insurance coverage for the Renter.

In case of multiple responsible incidents or incidents without an identified third party, the Renter’s financial liability will be calculated as follows: number of damages multiplied by the maximum financial liability amounts indicated in the Rental Agreement. In case of a wrongful accident claim, a flat indemnity corresponding to the maximum financial liability amount indicated in the Rental Agreement will be charged even if the rented vehicle shows no damage.

The amount charged to the Renter by the Lessor will systematically include immobilization fees and claim management fees for a flat rate of €500 including tax. The Lessor disclaims all liability for theft or damage caused to personal belongings carried in the vehicle.

Insurance Exclusions:

The Renter will lose all insurance guarantees and will be liable for the full cost of repairs or the expert-assessed market value or maximum replacement value of the vehicle in the following cases:

  • Any mechanical damage resulting from causes listed in Article 2 of these General Rental Conditions;
  • Driving underage or without valid driving licenses;
  • Renting or driving the vehicle under false identity or providing false information on the Rental Agreement or amicable report;
  • Damages caused intentionally, through gross negligence, or serious fault;
  • Mechanical damages caused by carrying more passengers than authorized on the vehicle registration;
  • Mechanical damages caused by carrying loads exceeding authorized limits on the vehicle registration;
  • Any damages to tires or rims unless proven not caused by fault or negligence;
  • Damage to the seat or dashboard unless proven not due to fault or negligence;
  • Fueling errors;
  • Mechanical damages occurring after the scheduled return date, unless written extension authorization is obtained from the Lessor (Note: during any authorized extension, insurance coverage may not apply without written Lessor approval);
  • Theft by an agent of the Renter or failure to return the original keys after vehicle theft is confirmed;
  • Damage caused by civil or foreign war (article L121-8 of the Insurance Code), riots, popular movements, terrorism, or sabotage within coordinated actions;
  • Faults involving serious violation of the Highway Code or offenses related to vehicle driving, parking, or general use;
  • Suicide attempts;
  • In case of natural disasters as legally defined, only the amount fixed by ministerial decree will be charged, even if the Renter subscribed to insurances offered by the Lessor.

Article 15: Interpretation

If any provision of these General Rental Conditions is found to be null, illegal, or unenforceable under applicable law, that provision shall be deemed not to be part of these General Rental Conditions. However, the remainder of the provisions shall remain fully applicable and in effect.

Article 16: Jurisdiction

By express agreement and subject to applicable legislation, the Commercial Court with jurisdiction over the Lessor’s registered office shall have exclusive competence to hear any dispute relating to this contract.

However, the Lessor may waive the benefit of this jurisdiction clause, which is stipulated in its favor. In that case, disputes will be brought before the courts territorially competent according to common law.

Article 17: Data Protection and Privacy

Personal data relating to natural persons will be communicated to the National Commission on Informatics and Liberty (CNIL) and used solely for administrative management purposes, internal commercial actions, or to comply with legal or regulatory obligations.

Individuals have the right to access and correct their data under the terms of Law No. 78-17 of January 6, 1978, relating to data processing, files, and freedoms. To exercise this right, please write to:

Article 18 : Connexion et géolocalisation des motos

Pour optimiser la gestion de notre flotte (kilométrage, niveau de carburant, alertes moteur, collision), protéger les véhicules et détecter les infractions, Envie2rouler équipe ses motos de dispositifs électroniques de suivi et de contrôle. Ces données peuvent être utilisées pendant et après la location. En acceptant ces Conditions Générales, vous consentez à l’utilisation de ces technologies.

Toute manipulation, débranchement ou détérioration de ces dispositifs entraînera des pénalités à votre charge.

Conformément à la loi, vous disposez d’un droit d’accès, de rectification, de suppression, d’opposition, de portabilité, et du droit d’organiser le sort de vos données après votre décès. Pour exercer ces droits, contactez-nous par courrier ou par email :
